Artwork Appraisal Terms and Conditions
1. Artchart.net (referred to as “Artchart” or “we” in this document) provides you with art valuation services contingent upon your agreement with the terms outlined below. These terms and conditions may be modified at any time without prior notice.
2. The online valuation service provided by Artchart is solely based on the images and information you submit. The accuracy of the valuation depends entirely on the accuracy of the descriptions, condition, and provenance you provide. Online valuations have inherent limitations, as they lack the detailed physical inspection possible in person.
3. Artchart’s goal is to deliver a valuation report based on fair market value, defined as the price a willing buyer would pay to a willing seller under normal conditions—without undue pressure to buy or sell, and with both parties being fully informed. This valuation reflects our opinion based on comparables, rarity, gallery and auction sales data, popularity, condition, and current market trends.
4. Artchart’s report includes a valuation range (minimum and maximum estimates) based on fair market value. We reserve the right, at our sole discretion, to decline to issue a valuation report without providing any explanation.
5. The fee for the valuation report is as listed on the Artchart website. We reserve the right to change fees periodically and offer discounts or special offers as we see fit. Payments for valuation reports are non-refundable, except in cases where the report is not delivered within ten (10) business days from payment—provided you have submitted all required and satisfactory information. If you choose to accept the delayed report, we may offer you a complimentary subscription as a goodwill gesture.
6. Our valuation does not take into account reserve prices, sale expectations, commissions, or taxes. It reflects only the total amount a buyer might reasonably pay, exclusive of such costs.
7. All information provided to Artchart regarding your artwork is assumed to be accurate and complete. We are not responsible for errors or omissions resulting from inaccurate or incomplete information. You are expected to provide all available documentation in your possession or control (e.g., invoices, previous valuations, certificates of authenticity, prior insurance reports, etc.).
8. You warrant that you have secured the rights to use and share any images, information, or other content provided to Artchart, and that doing so does not infringe on the rights of any third party.
9. By requesting a valuation, you confirm that you have the legal right to request such a report for the artwork in question, and that the artwork is not subject to inheritance disputes, liens, or other third-party claims.
10. All estimates and opinions provided by Artchart are derived from credible sources and believed to be reliable. However, we are not responsible for the accuracy of information provided by third parties.
11. The valuation report is based solely on the information and images provided by you, with no physical inspection, restoration, or investigation of provenance performed.
12. Our conclusions are based on our opinion more than on verifiable facts. We make no warranties or representations regarding authenticity, origin, title, age, condition, salability, or fitness of the artwork for any specific purpose.
13. Our estimate of fair market value does not guarantee that the artwork will sell at that price.
14. In case of any error in the report, our liability is limited to refunding the valuation fee. The report is prepared solely for your personal use, and you accept full responsibility for it. Artchart bears no liability for any loss or damages resulting from your use of the valuation, regardless of theory (contract, tort, etc.). We are not liable for any special, indirect, incidental, or consequential damages, including loss of profits. We strongly recommend that you consult with professional advisors before making any purchase, sale, or investment decisions based on the valuation.
15. The valuation report is not a pricing certificate and may not be transferred, disclosed, or used for legal, insurance, or other official purposes without prior written consent from Artchart. The report remains the intellectual property of Artchart.
16. By paying the valuation fee, you agree to these binding terms and acknowledge that a valuation is a subjective estimate based on professional judgment. Fair market values may vary by individual or context, and artwork value is affected by market conditions which may change over time. Reports are issued for a specific point in time.
17. If you do not agree to these terms, do not proceed with the valuation request.
18. Any disputes relating to the valuation report will be governed by the laws of the Islamic Republic of Iran, and you agree to submit all claims exclusively to courts within Iran. This does not prevent Artchart from pursuing claims in other valid jurisdictions.
19. You agree to hold Artchart, its affiliates, partners, agents, directors, and employees harmless from any claims, losses, or damages—including legal fees—arising from your breach of these terms, your use of the report, or any inaccuracies in the information you provided.
20. By paying for the valuation report, you accept and agree to these terms. This agreement constitutes the entire agreement between you and Artchart regarding the valuation service. Failure by Artchart to enforce any part of this agreement shall not constitute a waiver. Artchart is a trading name of Artchart.net. If any term is found to be unenforceable or unlawful, it shall be replaced with a valid provision closest in meaning, without affecting the rest of the agreement.
